It is unlawful for any person to possess an open container of an alcoholic beverage while operating a vehicle or while a passenger in or on a vehicle being operated. Any operator of a vehicle who violates this law is guilty of a noncriminal moving traffic violation and will be fined. A passenger of a vehicle who violates this law is also guilty of a noncriminal nonmoving traffic violation and will also be fined[1].

 

In 2009, there were 20,085 alcohol related traffic accidents in Florida resulting in 1,004 deaths and 14,130 injuries. To steer clear of many problems associated with alcohol, always use a designated driver or a ride sharing platform. This may not only protect your license, but also your life.
